The Challenge
Brent Council issue an Enforcement Notice alleging a breach of two planning conditions for a residential development already occupied.
Our Approach
Following our review of the Enforcement Notice and application documents, it was evident that the conditions imposed did not meet the condition tests set out within the National Planning Policy Framework. With this considered, we appealed the Enforcement Notice through challenging the validity of the two conditions in the first place, in addition to the requirements outlined within the Enforcement Notice itself. The Inspector agreed that the first condition was not legally imposed and that regarding the other, no breach had occurred. The Notice was subsequently quashed.
